Advertiser Terms & Conditions

By using this service you accept the terms and conditions of trading with Network 2 Supplies Limited (a company registered in England under number 04617783) (‘N2S’) and agree to adhere to our guidelines as published on the site.

1.    Adverts –

(a)    Adverts must not contain any offensive material or language and must not promote any knowingly illegal trading practices. This includes, adult content, racist hateful or abusive content.

(b)    Adverts must be for appropriate items that are genuinely for sale and that you have the right to advertise for sale as the owner or have the owner’s permission.

(c)    You warrant that the items you advertise for sale are not stolen and that they are genuinely accurate to the description of the advert you place including likeliness of any images and product specification, expiry dates etc.

(d)    N2S reserves the right to remove any advert that we believe breaches these terms and any money received will not be refunded and the fees donated to a charity of our choice.

2.    Making offers and communications on our site –

(a)    All questions and answers are displayed in the advert on our site for the public to see.

(b)    Any attempt to divert the trade off our site for a private sale is in breach of our terms and conditions and any customer clearly doing this will receive a warning notification. Any further attempts to do this will result in that customer being barred from using our site. For the avoidance of doubt this includes posting phone numbers and emails and soliciting users to communicate offline before a sale has been agreed and payment made. We always facilitate direct dialogue post sale to ease practicalities around the logistics etc.

(c)    Making offers – buyers can make and retract any offer & offers are not binding until accepted by you. If a buyer makes an offer and it is accepted by you you must complete the transaction and dispatch the acquired item within two working days of purchase. If you fail to complete the transaction you must notify us within 24 hours. Failure to do this causes buyer frustration and damages their perception of N2S. If a seller repeatedly does not complete on accepted offers they may be barred from using our site. We really don’t want to do that but must protect the buyers from a sale that isn’t going to complete.

(d)    Any sales of items advertised on our site shall be concluded on the Purchaser Terms and Conditions (read more here) which you agree to comply with.  You will provide us with an email contact address.

3.    Payment terms –

(a)    You agree to pay our commission on any sale of items advertised through the site.

(b)    If you sell an item through another advertising channel and genuinely made contact with a buyer that has not seen your advert on our site then you must make your case in writing to our CEO and fair consideration will be given to this. Failing this the commission fee due to us will become due.

(c)    We reserve the right to change our commission structure and warrant that the commission rates that are advertised on the site at the time of placing the advert will be honoured for the duration of the advert life or 6 months whichever is the shorter.

(d)    Payments made through the site will have our commission deducted from source.

(e)    All prices advertised and any accepted offer must include a notification that in addition to the identified price all eligible taxes including VAT will also be payable.

(f)    Any sale from an offer made on our site that is completed by a payment outside the N2S site, will result in an invoice being generated by us upon notification, to be paid within 14 days of invoice date.

(g)    All adverts will be treated as WSO (web sale only) unless otherwise agreed with us.

Commission structure as a % of transaction sale price:

Self Service:         Commission 15%
Assisted:              Commission 30%

4.    Disputes –

At N2S, we aim to be a great company to do business with. Our values are anchored in trust, honesty and no nonsense trading. If you feel we have breached our own promise to you in anyway please advise us directly by emailing us at help@stockex.n2s.co.uk

5.    Responsibility for loss or damage suffered by you if you are a business –

5.1    Nothing in these terms shall limit or exclude liability for:
(a)    death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);
(b)    fraud or fraudulent misrepresentation; or
(c)    any matter in respect of which it would be unlawful for us to exclude or restrict liability.
5.2    Except to the extent expressly stated in clause 5.1 all terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded.
5.3    Subject to clause 0:
(a)    we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss; and
(b)    the total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the lower of (i) the market value of and (ii) the advertised price of the goods or services advertised.

6.    How your  information may be used

The information you provide will be used to operate our business and for such other purposes as we consider appropriate

7.    Data cleansing

You shall ensure that all data contained in items supplied and sold as a result of an advertisement placed on our site that arises from or relates to the previous use of such items has been deleted prior to delivery to or collection by the buyer.

8.    Other important terms

8.1    You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. No other person shall have any rights to enforce any of these terms
8.2    Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
8.3    Any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
